1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of DaysFlow ("the App"), developed and operated by Dmytro Bondarenko ("Developer," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not download or use the App.
These Terms are intended to comply with the Apple App Store Review Guidelines. In the event of any conflict between these Terms and the App Store Terms of Service, the App Store Terms of Service shall prevail.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also acknowledge our Privacy Policy.
2. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.
You may not:
- Copy, modify, distribute, sell, or sublicense the App or any part of it
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the App or its related systems
3. Your Content
The App allows you to create and store personal data locally on your device, including event names, dates, notes, and preferences ("Your Content"). All Your Content is stored exclusively on your device and is not transmitted to our servers.
You retain full ownership of Your Content. We do not access, use, or claim any rights over data you create in the App.
You are solely responsible for maintaining backups of Your Content. We are not liable for any loss of data resulting from device failure, App uninstallation, or other circumstances.
3.1 Sharing Cards
The App allows you to generate shareable images of your event cards ("Shared Cards") via screenshots or widget previews, and share them through third-party platforms (e.g., social media, messaging apps).
When you share a card, you do so voluntarily and at your own discretion. You are solely responsible for any content visible in a Shared Card, including event names, dates, and any personal information you choose to include.
We do not receive, store, or process any Shared Cards. The Developer has no control over and assumes no responsibility for how Shared Cards are used, distributed, or received by third parties once you share them outside the App.
By sharing a card, you represent that you have the right to share all content contained within it and that doing so does not violate any applicable laws or the rights of any third party. You must not share cards that contain personal information about other individuals without their consent.
4. In-App Purchases and Subscriptions
4.1 Free and Premium Tiers
DaysFlow operates on a freemium model:
- Free tier -- core functionality is available at no charge, including creating and tracking a limited number of events
- Premium subscription (monthly or annual) -- unlocks the full feature set, including unlimited events, advanced customization, widget themes, and future premium features, billed on a recurring basis through your Apple ID
The specific features included in each tier may change over time. Current tier details may be viewed within the App or on the App Store product page.
4.2 Billing and Renewal
All purchases are processed by Apple through the App Store. By completing a purchase, you agree to Apple's payment terms. Subscription fees are charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
4.3 Free Trial
Where a free trial is offered, any unused portion of a free trial period will be forfeited when you purchase a subscription to the same feature set.
4.4 Cancellation
You may cancel a subscription at any time through your Apple ID account settings (Settings > [your name] > Subscriptions). Cancellation takes effect at the end of the current billing period; you retain access to premium features until that date.
4.5 Refunds
All refund requests are handled exclusively by Apple in accordance with their refund policy. We do not process refunds directly. To request a refund, please visit reportaproblem.apple.com.
4.6 Price Changes
We reserve the right to change subscription prices at any time. If a price increase applies to your subscription, Apple will notify you and request your explicit consent before the new price takes effect. Your subscription will not automatically renew at the higher price without your approval. If you do not consent, your subscription will not renew.
5. Intellectual Property
The App, including its design, code, graphics, icons, and content (excluding Your Content), is owned by Dmytro Bondarenko and protected by applicable intellectual property laws. Nothing in these Terms grants you any rights to our trademarks, service marks, or trade names.
The DaysFlow name and logo are proprietary to the Developer. You may not use them without our prior written consent.
6. Third-Party Services
The App uses the following third-party services, each governed by its own terms:
- Google Firebase (Analytics, Crashlytics, Remote Config) -- used for app diagnostics and performance monitoring
- Apple App Store (StoreKit) -- used for payment processing
We are not responsible for the practices or content of any third-party services. Your use of those services is subject to their respective terms and privacy policies.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the App will meet your requirements or that any defects will be corrected.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DMYTRO BONDARENKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless Dmytro Bondarenko from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, the license granted to you under these Terms will immediately cease. Sections 5, 7, 8, 9, and 12 of these Terms shall survive termination.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions. To the extent applicable, these Terms are also intended to comply with EU consumer protection regulations.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute may be referred to the competent courts of Ukraine.
Note for EU/EEA users: Nothing in these Terms affects your rights as a consumer under applicable EU law, including the right to access alternative dispute resolution (ADR) mechanisms.
12. Apple-Specific Terms
The following terms apply specifically to your use of the App obtained through the Apple App Store:
- These Terms are between you and the Developer only, not with Apple, Inc. Apple is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce them against you as a third-party beneficiary.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. When we do, we will update the Effective Date at the top of this document. For material changes, we will provide notice through the App or App Store release notes. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
